Terms of participation in social media competitions

Rules for participation in competitions on the Facebook and Instagram social networks.

1.Organiser

1.1The organiser of the competition is Altoa s.r.o., with registered office at: Maiselova 38/15, 110 00 Prague 1 - Josefov, ID No.: 02620995, VAT No.: CZ02620995, registered in the Commercial Register kept by the Municipal Court in Prague, file C, insert 221494 (hereinafter the “Organiser”).

2.Competitions

2.1The Organiser announces competitions through posts on the Facebook and Instagram social networks (hereinafter the “Posts”). Competitions announced through the Posts are governed by these Terms in matters that the Posts do not expressly regulate otherwise.

3.Competition period

3.1Each competition runs during the period specified in the relevant Post (hereinafter the “Competition Period”).

4.Competition participants

4.1Competitions may be entered by all natural persons with a delivery address in the Czech Republic (hereinafter the “Participants”) who have reached the age of 18 (persons under 18 may participate only with the consent of their legal representative).
4.2Anyone who, during the Competition Period, correctly answers the question posed by the Organiser in the Post and/or fulfils other conditions set by the relevant Post for participation in the competition, will be included among the Participants.
4.3Participation in the competitions is not conditional on any purchase of goods. Participation in the competitions is free of charge and Participants incur no financial or other obligations towards the Organiser arising from participation in the competitions.
4.4Each Participant may enter the relevant competition only once during the entire Competition Period.
4.5Competitions may also be entered under a pseudonym.

5.Competition winners

5.1The winners of the competitions become those Participants who are (in accordance with the rules stated in the relevant Post) drawn and/or selected by the Organiser (hereinafter the “Winners”).
5.2The prizes stated in the relevant Post will always be distributed among the Winners.
5.3Each Participant may win only once within a single competition.
5.4If (e.g. due to incorrect contact details) it is not possible to reach the Winner, the Winner’s claim to the prize lapses without entitlement to any compensation.

6.Prizes

6.1Prizes are always specified in the relevant Post.
6.2Winners are not obliged to accept the prize.

7.Notification of winning

7.1All Winners will always be informed of their win as a reply under their competition comment on the Post, within 14 days from the day they are drawn and/or selected by the Organiser (hereinafter the “Notification of Winning”).
7.2If the Winner does not respond to the Organiser within 7 days from the date of the Notification of Winning, the Winner’s claim to the prize lapses without entitlement to any compensation.

8.Exclusion from participation in the competition

8.1All Participants who in any way (even marginally or partially) fail to comply with these Terms or breach them are excluded from the competition.
8.2The Organiser is further entitled to decide on the exclusion of those Participants where there is a reasonable suspicion that they are engaging in unfair, fraudulent or dishonest practices in the competition. Such practices include in particular, but are not limited to:
  1. the use of impermissible means (e.g. hacking tools, viruses, Trojan horses, etc.) or obtaining another advantage by manipulation,
  2. participation through prize-winning associations, automated services, and especially through professional prize-winning services,
  3. participation in the name of a third party without their knowledge;
  4. the use of impermissible expressions or vulgarisms.
8.3Employees of the Organiser and all employees of agencies and companies cooperating with it, as well as persons close to such persons, are excluded from the competition and cannot become Participants.
8.4If a Participant who has become a Winner of the competition is excluded from the competition, their claim to the prize lapses; if the prize has already been provided, they are obliged to return it to the Organiser.
8.5If the Organiser finds or believes that there is any suspicion of a breach of these Terms by a Participant, the Organiser is entitled to exclude such Participant from the competition without notice.
8.6The Organiser’s decision is final, with no possibility of appeal.

9.Exclusion of liability for damages

9.1The Organiser is not responsible for any technical failures and outages or for the functionality of internet and social networks, and further is not liable for damages incurred by a Participant through participation in the competition, provided that such damages are not caused intentionally or by gross negligence.

10.General terms

10.1Competitions announced through Posts are in no way connected with the companies operating the Facebook and Instagram social networks (hereinafter the “Companies”), are not organised or sponsored by them.
10.2Within the competitions, Participants provide their data to the Organiser, as the administrator of the Organiser’s page on the Facebook and Instagram social networks.
10.3Information obtained from Participants will be used only for the purposes of the relevant competition.
10.4None of the Companies is responsible for the content of the competitions, only the Organiser is. The Companies are in no way connected with these competitions. Any liability on the part of the Companies is therefore expressly excluded.
10.5By participating in the competition, the Participant expresses their consent to these Competition Terms and undertakes to comply with them in full.
10.6The Organiser will, as controller, process the personal data of Participants for the purpose of performing the contractual relationship between the Participant and the Organiser, which arises from the Participant’s participation in the competition. This is therefore processing of personal data that does not require consent and whose legal basis is Article 6(1)(b) GDPR. The Organiser will process Participants’ personal data to the extent necessary for the implementation of the relevant competition, under the following conditions:
  1. Personal data processed: those provided by Participants in their competition comment on the Post, at minimum first name, surname, possibly Facebook ID and pseudonym on Facebook and/or Instagram. If a Participant becomes a Winner, the Organiser will also process their contact details for the purpose of delivering the prize.
  2. Period of processing: for fourteen days after the Organiser has dispatched the prize.
  3. Purpose of processing: running of the competition, selection of Winners, distribution of prizes.
  4. Legal basis of processing: performance of the contractual relationship under Article 6(1)(b) GDPR.
  5. Personal data controller: the Organiser, or other persons (processors) entrusted by the Organiser with the processing.
  6. Where the conditions stipulated by legal regulations are met, Participants have the following rights related to the processing of their personal data, which they may exercise with the Organiser by any means, in particular in writing at the Organiser’s registered office (see point 1.1 above) or via the email address dpo@altoa.cz:
    • right of access to personal data, consisting of the right to receive free of charge, upon request, information on which of their personal data the Organiser processes;
    • right to rectification of incorrectly processed personal data;
    • right to erasure of their processed personal data;
    • right to restriction of processing of their personal data;
    • right to data portability;
    • right to lodge a complaint with the supervisory authority, which is the Office for Personal Data Protection (www.uoou.cz);
    • in the case of questions regarding the processing of personal data by the Organiser, Participants may contact the Organiser’s data protection officer via the email address dpo@altoa.cz.
10.7The Organiser reserves the right to make the final decision in connection with the running of the competition.
10.8The Organiser is entitled, without compensation, to suspend, withdraw or cancel the competition, or to unilaterally amend or supplement the Terms.
10.9Prizes in the competition cannot be enforced by legal means or alternatively in money. All prizes that are not collected even by a substitute winner are forfeited to the Organiser. The Organiser is not liable for defects, damage or losses associated with the delivery of prizes.
10.10The Organiser is not liable for any defects of the prizes.
10.11Complaints relating to the course of the competition must be made no later than within 7 days of the reason for the complaint arising, in writing to the Organiser’s registered office. If such complaints are found to be justified, they will be handled within the Organiser’s Public Relations department. Complaints made by telephone or complaints made outside the period stated in the previous sentence will not be taken into account.
10.12The Terms are governed by the valid and effective legal regulations of the Czech Republic.
10.13The Terms are available directly on the Organiser’s website and at the same time are stored in written form at the Organiser’s registered office.
